Richmond, Va. (AP) — The ACLU of Virginia has filed a brief with the U.S. Supreme Court asking justices not to review a ruling that a transgender boy be allowed to use the boys bathroom at his high school.

The civil rights group said in a news release that it had filed the brief Tuesday. The ACLU had brought a case on behalf of 17-year-old Gavin Grimm against the Gloucester County School Board. The board had barred Grimm from using the restroom that matches his gender identity.

The 4th U.S. Circuit Court of Appeals said the policy violates Title IX, a federal law that prohibits discrimination in schools. The Supreme Court ruled last month that the school board can require Grimm to use a private restroom until it decides whether to intervene.
